What is the Batiste and Bare Dry Shampoo Settlement About?

A $2,500,000 class action lawsuit has been settled with Batiste dry shampoo, as well as Church & Dwight, Co. Inc. (C&D), a company markets specific dry shampoos. The settled class action lawsuit contends that by not advertising certain Batiste shampoo products as containing an ingredient called benzene the defendants were practicing deceptive marketing and false advertising.

A $3.65 Million Class Action Lawsuit was settled in early 2023 over Sure and Brut antiperspirant spray products. The Sure and Brut deodorant class action lawsuit similarly alleged that by not advertising certain Brut and Sure deodorants as containing an ingredient called benzene, the companies were practicing deceptive marketing and false advertising. Sure and Brut had also issued a recall prior to this class action lawsuit being settled.

A similar situation resulted in a massive national product recall. The consumer recall was issued by Procter and Gamble in 2022 over the same ingredient, known as benzene, over certain P&G shampoos and conditioners such as Pantene, Aussie, Herbal Essences, HairFood, Old Spice, and Waterless.

Another class action was settled in 2022 over Coppertone Sunspray products that contained potentially dangerous levels of Benzene. Coppertone settled that class action for $2.3 Million, although the manufacturer of Coppertone did not accept any wrongdoing or admit that benzene posed any danger to customers.

There is also an ongoing voluntary recall for certain dry shampoo products like Dove, Tresemme, Suave, Nexxus, and other dry shampoos and conditioners produced by Unilever that may contain benzene.

What is Benzene?

Benzene, which is at the center of the Batiste Dry Shampoo Class Action Settlement, is a well known odorless, and colorless chemical. Prolonged exposure to benzene carries serious health risks and consequences. Thus, the CDC and FDA recommend that consumers be aware of ingesting or consuming benzene in products, as well as the environment. How Do I Qualify?

You may qualify for the Batiste / Bare open class action if you purchased certain Batiste for your own personal use, and not for resale in the United States. You will not need proof of purchase for up to 5 products claimed. If you claim more than 5 Batiste or Bare dry shampoos, you will need to provide evidence of purchase in a legitimate form such as a receipt. The qualifying dates of purchase are any time through May 30, 2023.

How Much Can I Get for the Dry Shampoo Settlement?

The total settlement amount is $2,500,000. If you file a valid claim, and do not have proof of purchase, the class action will pay for up to 5 products that are covered (see list above for covered sprays) at $2.00 per product, estimated. If you claim more than 5 products in your claim form, you will need to provide proof of purchase in order to qualify for a full payout.

The class action settlement also provides for coupons / vouchers that will be an additional fund of $600,000.00. The money will be made available to those consumers who claim that they purchased Batiste™ Products other than Bare™ dry shampoo products. If there are a large number of valid claim forms filed, the payout may be smaller than the estimated $2.00 per dry shampoo. The same is true for the reverse.
